PS Shops Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of PS Shops (the “Platform”). By accessing or using PS Shops, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.

1. Definitions

  • “PS Shops” means the multi-vendor e-commerce platform operated by PS Sops

  • “PS Delivery” means the logistics company that executes delivery of orders placed on PS Shops.

  • “Seller” means any business or individual offering goods for sale on PS Shops.

  • “Buyer” means any customer purchasing goods through PS Shops.

  • “We/Us/Our” refers to PS Shops and its parent company.

 

2. Eligibility

  • Users must be at least 18 years of age to create a seller or buyer account.

  • Sellers must hold all licenses, registrations, and approvals required by Bahamian law to operate their business and sell listed products.

  • Accounts must be created using accurate and verifiable information.

 

3. Account & Access

  • Sellers must register with a dedicated business email and provide accurate business and banking information.

  • You are responsible for keeping your login credentials secure.

  • PS Shops reserves the right to suspend or terminate accounts at any time for violations of these Terms or applicable law.

 

4. Listings & Products

  • All products must comply with Bahamian law and the PS Shops Restricted & Prohibited Products Policy.

  • Listings must be accurate, truthful, and not misleading.

  • Sellers must provide high-quality images, clear specifications, and full descriptions.

  • Counterfeit, illegal, unsafe, or unauthorized items are strictly prohibited.

  • Where a government license is required to sell a product, the same license is required to list it on PS Shops.

 

5. Orders & Delivery

  • All marketplace deliveries are executed by PS Delivery.

  • Sellers must package and label items securely and have them ready for pickup on time.

  • Same-day cutoff is 12:00 PM Nassau time. Orders placed or confirmed after that time will ship the following business day.

  • PS Delivery provides proof of delivery (photo, timestamp, or signature), which will be used to resolve disputes.

 

6. Returns & Refunds

  • PS Shops does not allow buyer’s remorse returns.

  • Returns are only accepted when the seller is at fault. Qualifying reasons include:

    • Wrong item shipped

    • Defective on arrival

    • Not as described (major differences, missing parts)

    • Damage caused by poor packaging

  • Buyers must file claims within the required timeframe (48 hours for defects/damage, 7 days for wrong/not-as-described).

  • Approved claims require the seller to provide a replacement or refund at no cost to the buyer.

 

7. Payments & Fees

  • Buyers agree to pay all charges at checkout, including product price, delivery, and applicable taxes.

  • Sellers agree to pay PS Shops’ referral and per-item fees as outlined in the Seller Fees Schedule.

  • Payouts to sellers are made weekly, directly to their Bahamian bank accounts.

  • PS Shops reserves the right to withhold or delay payments for accounts under investigation.

 

8.Performance Standards

  • Sellers must maintain minimum performance metrics:

    • Order Defect Rate < 2%

    • Late Shipment Rate < 4%

    • Cancellation Rate < 2%

  • Repeated failures may result in account suspension or removal.

 

9. Intellectual Property

  • Sellers may only list products they are authorized to sell.

  • Unauthorized use of another party’s trademark, copyright, or branding is strictly prohibited.

  • Counterfeit products are grounds for permanent suspension.

 

10. Data & Privacy

  • Buyer information (names, addresses, phone numbers) may only be used for fulfilling orders.

  • Off-platform marketing or misuse of buyer data is prohibited.

  • PS Shops may collect and use data from sellers and buyers in accordance with its Privacy Policy.

 

11. Prohibited Conduct

You may not:

  • Use PS Shops for illegal purposes.

  • Circumvent fees or attempt off-platform transactions.

  • Harass or mislead buyers, sellers, or staff.

  • Manipulate, buy, or threaten for reviews or ratings.

 

12. Account Suspension & Appeals

  • PS Shops may suspend, restrict, or terminate accounts for violations of these Terms or applicable law.

  • Suspended sellers may submit a written Plan of Action (detailing violation, corrective measures, and prevention plan) to appeal.

  • PS Shops’ decision is final.

 

13. Taxes & Compliance

  • Sellers are responsible for all taxes, customs duties, and regulatory compliance for their products.

  • PS Shops does not calculate or remit taxes on behalf of sellers.

 

14. Liability & Disclaimers

  • PS Shops is a platform. We are not the manufacturer, seller, or guarantor of products.

  • Sellers are solely responsible for the legality, quality, and safety of their goods.

  • PS Shops does not provide insurance for orders. Insurance, if applicable, is governed separately by PS Delivery.

  • To the fullest extent permitted by law, PS Shops is not liable for indirect, incidental, or consequential damages.

 

15. Governing Law & Disputes

  • These Terms are governed by the laws of The Commonwealth of The Bahamas.

  • Any disputes shall be resolved exclusively in Bahamian courts, unless PS Shops elects binding arbitration.

 

16. Force Majeure

PS Shops will not be held liable for delays or failure to perform due to events beyond our reasonable control, including but not limited to: natural disasters, hurricanes, fires, floods, strikes, power outages, or government actions.

 

17. Updates to Terms

  • PS Shops may update these Terms at any time. Updates are effective immediately upon posting.

  • Sellers and buyers are responsible for reviewing the Terms regularly. Ignorance of updates is not a defense.
